Two common starting points

Will-based or Trust-based?

The right starting point depends on your family, property, goals and the complexity of your wishes. Trust & Will can guide you through the choice.

Will-based estate plan

A practical foundation for documenting who should receive your property and who should make important decisions if you cannot.

  • Name guardians for children and pets
  • Choose how assets should be distributed
  • Designate health care agents
  • Document medical and final wishes

Trust-based estate plan

A more comprehensive option that includes a Will and may provide added control over how property is managed and distributed.

  • Create a revocable living trust
  • Add conditions to asset distributions
  • Plan for trust ownership of eligible property
  • Potentially help assets avoid probate

Not sure? That is normal. Start with the guided questions or ask Nick before moving forward.

Common questions

A little clarity before you begin.

If your question is not here, call or email. You will not be bothering us.

What is the difference between a Will and a Trust?

A Will generally takes effect after death and lets you name guardians, direct property and document final wishes. A revocable living Trust becomes effective while you are living once it is properly created and funded. It may offer additional control and help certain assets avoid probate.

How long does the online process take?

Many people can work through the guided questions in about 30 minutes. You can save your progress, talk through a decision and return later, so there is no need to rush.

Is Trust & Will a law firm?

No. Trust & Will is not a law firm and does not provide legal advice. Independent attorney support is available in most states for an additional fee. More complex situations may require working directly with a local estate-planning attorney.

What happens after I create the documents?

You will receive instructions for reviewing, signing and notarizing the documents where required. Nick can then help you review the summary and coordinate applicable beneficiary, ownership and trust-funding steps involving accounts managed through Heartland.

Will Nick see all of my answers?

Your Trust & Will account is yours. Heartland's role is to support the financial-planning process and review the plan summary you choose to share—not to replace an attorney or make legal decisions for you.
